(Effective February 2, 2016 Social Security has posted the following on its website)

WHEN TO RECOGNIZE SAME-SEX MARRIAGES FOR TITLE II & MEDICARE BENEFITS

(Note:  Title II relates to Federal Old–Age, Survivors & Disability Insurance Benefits)

 We will recognize a valid same-sex marriage as of the date of the marriage, including during periods when the number holder’s (NH’s) state of domicile did not recognize same-sex marriages, if the initial claim was:

  • filed on or after June 26, 2015 (date of the Obergefell Decision) ; or
  • pending a final determination at any level of review on or after June 26, 2015.

For post-entitlement actions, we will also recognize a same-sex marriage as of the date of the marriage.”
