Prenuptial and Postnuptial Agreements
Prenuptial agreements help couples define the status of their marital financial details, providing transparency throughout the marriage. Also, it can put a structure in place if the couple decides to divorce. Prenuptial agreements can address a variety of topics, from defining marital debts and assets, to addressing future spousal support and rights of inheritance to a spouse’s assets.
Effective March 23, 2023, Ohio now also allows married couples to enter into enforceable Postnuptial Agreements. These agreements can address the same issues that could be addressed in a Prenuptial Agreement.
Whether you are interested in obtaining a Prenuptial or Postnuptial Agreement, there are some basic requirements that must be met in order for them to be enforceable. It is always best for the intended spouses or married spouses to have representation from an attorney with experience in preparing and reviewing these Agreements. Attorney Tom Addesa has experience in both drafting Agreements and reviewing Agreements drafted by other attorneys and can provide legal advice on the implications of the provisions contained in these documents.
